Terms of Sale

1. Company Information

These general terms and conditions of sale (“Terms of Sale”) apply to CTEK AB with registered address Strandvägen 15, SE - 791 42 Falun, Org. No. 556540-3234.

2. General

The Terms of Sale apply to all online sales by CTEK on the website ctek.se (the “Website”) to end consumers, excluding the application of other terms (e.g., terms applicable in physical stores).

The Terms of Sale applicable to a purchase are those in effect at the time the order is placed.

The Customer should read the Terms of Sale carefully before placing an order. These terms explain to the Customer who CTEK is, how we deliver our products to the Customer, how the Customer and CTEK may end or amend the contract, what to do if problems arise, and other relevant information. If the Customer believes any part of the terms is unclear, the Customer is encouraged to contact CTEK.

Deviations from the Terms of Sale are only valid if agreed upon in writing by both parties.

CTEK reserves the right to amend the Terms of Sale at any time. The new terms then apply to all orders placed after such changes are made.

The Terms of Sale are available on the Website.

Unless otherwise stated, the data registered on the Website constitutes the proof of all transactions between CTEK and its customers for purchases made through the Website.

3 Order Process

3.1 Product Selection

All online orders must be placed directly on the Website.

The Customer selects product(s) by clicking the “Add to cart” button.

The Customer can view selected products in the cart at any time. The Customer can choose between the payment methods provided by CTEK via Kustom’s Checkout and see any applicable shipping fees.

3.2 Registration of the Order

After selecting product(s), the Customer is given the opportunity to review the order details and the total amount. Any errors can be corrected before the order is approved and becomes binding.

The Customer enters the information necessary for delivery of the order.

The Customer then selects a payment method and enters the relevant payment information.

3.3 Final Confirmation of the Order

By clicking the “Complete purchase” button at the end of the order process, the Customer accepts the Terms of Sale and CTEK’s privacy policy (GDPR).

CTEK encourages the Customer to read both the Terms of Sale and the GDPR policy. After the Customer’s order and payment have been confirmed, we send an electronic order confirmation to the email address provided by the Customer. The purchase agreement is finalized when the Customer receives the order confirmation.

The terms of an order may be changed until CTEK has confirmed the order.

Any changes made by the Customer after changes in CTEK’s prices will result in the new prices being applied automatically.

CTEK reserves the right to reject orders. In such cases, instead of an order confirmation, an email is sent to the Customer’s email address provided at the time of the order.

Right of Withdrawal

4.1 Rights and Timeframe for Withdrawal

According to the Swedish Distance and Off-Premises Contracts Act (2005:59), the Customer has the right to withdraw from a purchase without giving any reason within fourteen (14) days from the date the product ordered on the Website was received by the Customer.

If the order contains several products to be delivered separately, the withdrawal period for all products begins on the date the last product was received.

4.2 Conditions for Exercising the Right of Withdrawal

To exercise the right of withdrawal, the Customer must notify CTEK that they intend to withdraw from the purchase before the withdrawal period expires. The Customer is recommended to use one of the following methods:

Send a clear and unambiguous message expressing the Customer’s intention to exercise the right of withdrawal to us via our contact form.

For more information about the right of withdrawal, the Customer may contact CTEK’s customer service through our contact form.

4.3 Returns and Refunds

The Customer has fourteen (14) days to return the product from the date the Customer informs CTEK of their intention to exercise the right of withdrawal. Note that the right of withdrawal cannot be processed if the Customer returns the product without/before notifying CTEK that they intend to withdraw from the purchase.

The return is always at the Customer’s expense, with tracking, and under the Customer’s responsibility to the following address:

Returns may be sent with any shipping provider but must always include tracking.

To receive a refund, the product must be properly packaged and in such condition as can reasonably be expected considering that the Customer only has the right to inspect the product in the same way as in a physical store. The invoice, or a copy of the invoice if only part of the order is returned, must be included. CTEK reserves the right to reduce the refund amount if the serial number is missing due to something caused by the Customer that goes beyond inspection equivalent to that in a physical store.

After the return has been registered by CTEK, and if CTEK has no legal objections, CTEK will refund, via Shopify Payments, the total amount paid for the returned product, including shipping cost from CTEK to the Customer (based on CTEK’s standard delivery option), using the same payment method used for the original purchase, without undue delay.

CTEK/Shopify Payments do not refund additional costs incurred due to the Customer choosing a more expensive shipping method than CTEK’s standard shipping option.

5 Prices

The Customer is charged the prices and in the currency indicated on the Website and agreed upon in the purchase contract.

Unless otherwise explicitly stated by CTEK at the time the order is placed, prices include VAT and packaging costs, excluding shipping costs, and CTEK reserves the right to choose the means of transportation.

6 Product Availability

Products and prices are valid as long as they appear on the Website, subject to stock availability.

Errors or changes may occur in exceptional cases. “In stock” status on the Website is not guaranteed, as errors or changes may occur exceptionally. If a product becomes unavailable after an order is placed, the Customer will be informed by email (or by letter if no email address was provided) regarding the unavailability and the delivery of a partial order or cancellation of the order.

If the amount has already been charged, the Customer will be refunded the amount paid for the unavailable product within thirty (30) days.

7 Delivery

Products purchased on the Website are only available for delivery within Sweden. The Customer is responsible for providing correct information at the time of ordering. If incorrect contact information has been provided (particularly surname, first name, address, postal code, city, phone number, and email address), CTEK cannot be held liable for the inability to deliver the order.

Delivery is sent from our central warehouse in Ghent, Belgium, and transportation is carried out by DHL Express. All shipments to consumers are sent with the GoGreen service, meaning the entire shipment is climate-compensated.

Consumers have two shipping options:

Standard shipping on orders over 595 SEK | 0 SEK | 4–6 days

*Note that express shipping does not apply to orders containing CS FREE, Boosters, or other products containing lithium batteries and may only be shipped using standard shipping.

Orders placed before 11:00 are handed over to DHL the same day.

The Customer receives a message from DHL with 6 delivery options:

  • Delivery to your door
  • Delivery to an alternative address, e.g., your workplace
  • Delivery to a neighbor
  • Pick-up point
  • Pick-up at DHL
  • Hold for vacation

The DHL message also contains a tracking link.

8 Transport – Receipt

The Customer is responsible for checking that the delivered product matches the order and that the packaging is in acceptable condition at the time of delivery, and must take any necessary action against the carrier.

In the event of damage to the product, the Customer must:

• Report the damage on the delivery slip;
• Send a registered letter with proof of receipt to the carrier within three (3) days from the delivery date; and
• Send a copy of the above letter and delivery slip to CTEK at the following address:

9 Condition of the Product

CTEK undertakes to refund or replace a product that does not comply with the order. The Customer must report any visible discrepancies and return the product to CTEK, which will replace the product or issue a refund as per agreement with the Customer in each respective case. If the returned product is incomplete, dirty, or damaged, it will not be accepted by CTEK. Returns, exchanges, or complaints regarding products purchased on the Website must not be requested and/or carried out in physical stores.

10 Payment Methods

The product is paid for online and the customer chooses from the payment methods offered by the Shopify Payments service, including: Visa, Mastercard, American Express, and local methods such as Klarna and Swish via our checkout. All payment information is handled in an encrypted and secure manner according to PCI-DSS standards.

Payment is processed via Shopify Payments.

In the event of payment issues, CTEK reserves the right to stop delivery.

The order will be delivered once the Customer’s payment has been received by Shopify Payments in accordance with the usual delivery times specified in point 8 of the Terms of Sale.

11 Processing of Personal Data in Connection with Payment

Please note that CTEK does not process any payment information from you (e.g., credit card, bank details, or other equivalent information) because payment is made with Shopify Payments and via their payment services. By clicking ["purchase"/"continue"][1], you accept Shopify Payments' user terms and confirm that you have read Shopify Payments' privacy policy.

12 Retention of Title – Transfer of Risk

CTEK retains ownership of each product delivered until full payment for the product has been made and received by CTEK. The risk for the product transfers to the Customer at the moment the product is handed over or accepted.

If payment is not made, CTEK reserves the right to claim ownership of the respective product.

13 Customer Rights

13.1 Right to Make a Claim (Reklamationsrätt)

CTEK guarantees that the products comply with the order and are free from defects and hidden faults. Any claims by a customer based on this guarantee must be sent to the above-mentioned address.

The Customer has the right to complain about the ordered product pursuant to the conditions stated in the Swedish Consumer Sales Act (1990:932) within a specified period. The Customer has the right to make a claim for defects within three (3) years from the delivery of the product.

The Customer has the right to choose between remedying the defect or receiving a replacement product, subject to a reasonableness assessment pursuant to Section 26 of the Consumer Sales Act.

CTEK is responsible for defects that existed at the time of purchase even if the defect appears later. Defects that appear within six (6) months after delivery are considered to have existed at the time of sale unless CTEK can prove otherwise. After six (6) months, the burden of proof shifts to the Customer to demonstrate that the defect was original.

Statutory rights apply regardless of CTEK’s guarantee.

If remedy or replacement is not possible or does not occur within a reasonable time after the complaint, the Customer may demand a price reduction, and if the defect is significant, cancellation of the purchase pursuant to Sections 28 and 29 of the Consumer Sales Act.

13.2 Warranty

In addition to the statutory warranty rights mentioned above, the Customer is also covered by CTEK’s voluntary warranty in accordance with the requirements and conditions available here. The warranty for battery chargers under 10 Amps is 5 years. The warranty for accessories is 2 years. The warranty does not cover damage caused by improper handling of the product or by incorrect, unsuitable, or unreasonable use of the product. Damage caused due to maintenance or disassembly performed by a person or professional not approved by CTEK, modifications or alterations to the product, damage caused by poor packaging when returning the product, or damage from an accident is also excluded.

The warranty automatically becomes invalid if the serial number has been removed or erased. To benefit from CTEK’s voluntary warranty, the Customer must keep and be able to present the invoice for the product.

14 CTEK’s Liability

14.1 Compliance of the Product with Applicable Law

The products offered on the Website comply with Swedish legislation and other applicable Swedish and international regulations.

14.2 Scope of CTEK’s Liability

CTEK’s liability for damages is generally excluded except in the following cases:

a. loss or damage resulting from a breach of a material contractual obligation. A material contractual obligation is one that is essential for the proper execution of the agreement and upon which the other party may generally rely, such as delivery of a product without defects. In such cases, CTEK’s liability is limited to compensation for foreseeable, typical loss or damage.

b. loss or damage resulting from a breach of a warranty by CTEK.

c. loss or damage resulting from intentional or gross negligence by CTEK or by a legal representative or agent of CTEK.

d. loss or damage arising from injury to life, body, or health caused by intentional or gross negligence by CTEK or a legal representative or agent of CTEK.

e. claims under statutory liability, in particular within the framework of the Swedish Product Liability Act (1992:18).

This provision does not affect the legal distribution of the burden of proof.

The product images on the Website are for illustrative purposes only. Although CTEK has made every effort to display colors accurately, CTEK cannot guarantee that a device's display of colors reflects the exact color of the products. The Customer’s product may vary slightly from these images. Packaging may also differ from what is shown on the Website. The Customer is encouraged to read the description of each product to be informed of its exact functions, technical specifications, and compatibility. In cases of doubt or if further information is needed, contact CTEK customer service via our contact form.

CTEK is only responsible for the content on web pages created by CTEK. We reserve the right for any errors in pricing and product information or elsewhere on the Website. In the event of such inaccuracies, we reserve the right to correct them afterwards. We reserve the right to price adjustments, sold-out items, stock differences, technical issues, changes in technical specifications, and any typographical errors. We reserve the right to cancel incorrect orders.

CTEK is never liable for loss in business operations. CTEK only supplies products for internal and private use. If the Customer uses the product for commercial, business, or resale purposes, CTEK is not liable for any loss of profit, loss of business, business interruptions, or loss of business opportunities.

Full or partial inability to use the product for reasons beyond CTEK’s control, particularly due to equipment incompatibility, does not give rise to compensation, reimbursement, or liability from CTEK.

14.3 Force Majeure

CTEK cannot be held liable for non-performance of the agreement due to unforeseen events beyond its control, disruptions, or full or partial strikes, particularly affecting transport and/or communication services, fire, or flooding.

15 Intellectual Property

All texts, comments, works, illustrations, and images on the Website are protected by copyright.

The Customer may not modify paper or digital copies of materials printed or downloaded from the Website in any way, and may not use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text. CTEK’s status (and the status of any identified contributors) as holders of the content on the Website must always be acknowledged.

The Customer may not use any part of the content on the Website for commercial purposes without obtaining a license from CTEK or CTEK’s licensors. If the Customer prints or downloads any part of the Website in violation of these terms of use, the Customer’s right to use the Website will cease immediately, and the Customer must return or destroy all copies of materials at CTEK’s request.

16 Personal Data

CTEK follows all applicable data protection laws in Sweden. Please see CTEK’s Privacy Policy for complete information on how CTEK processes Customer personal data.

The Website is designed to improve user experience. For this purpose, cookies are used. See CTEK’s Cookie Policy for additional information on how CTEK uses cookies.

17 External Links

The Website may contain external hyperlinks redirecting the Customer to other websites. CTEK has no obligations regarding the companies and websites that customers may be redirected to from the Website and can under no circumstances be held liable for the content, operation, services provided, or accessibility of such websites.

The Customer may refuse cookies by adjusting browser settings. This may affect interactive functions on the relevant websites.

The Website is a secure website using SSL encryption.

20 Applicable Law and Jurisdiction

These Terms of Sale, as well as all related transactions in connection with the sale of products from CTEK to the Customer, are governed, interpreted, and enforced in accordance with Swedish law.

Any dispute arising from this agreement shall be settled in Swedish general court.

21 Offers, Discount Codes, and Gifts

From time to time, campaigns, gifts, and other offers (“Offer”) may be available. Such Offers are valid only during the time specified in connection with the Offer and as long as the product is in stock, and under the conditions stated in connection with the Offer. Offers cannot be combined with other discounts unless explicitly stated on the Website. You must enter any code or otherwise activate the Offer before completing your purchase. If you return ordered products, this may mean that you no longer meet the specific conditions of the Offer, which may require you to return any gift or no longer be eligible for a discount. If, due to a return, you no longer meet the conditions for the gift and do not return it, we will deduct the value of the gift before issuing your refund. Otherwise, these Terms of Sale also apply to Offers.

21.1 Revocation of an Offer

Upon termination or revocation of an Offer, these Terms of Sale apply to the products previously included in the Offer.

21.2 Discount Codes

We may from time to time provide discount codes for purchases on ctek.se. A discount code applies to all products on ctek.se (with the exception of gift card and discount code purchases). Discount codes cannot be combined with other codes. A discount code may only be used for a single purchase and is thereafter void. This also applies if you choose to withdraw your purchase in whole or in part — your discount code will not be reactivated, nor will you receive a new one. Only one discount code may be used per purchase. You must enter the discount code before completing your purchase for the discount to apply.

21.3 Abuse or Unauthorized Use of Discount Codes

We reserve the right to deny the use of a discount code if a code intended solely for a specific target group is used by an unauthorized person. Examples of specific target groups include clubs, associations, or internal campaigns for CTEK employees.

22 General

If CTEK cannot exercise any right under this agreement, this does not prevent CTEK from exercising other rights, or the same type of right at a later time. If any provision in these terms is found unlawful, invalid, or unenforceable, that provision shall be considered severed, and the validity and enforceability of the remaining provisions shall not be affected.

CTEK may transfer this agreement to someone else. CTEK may transfer its rights and obligations under these terms to another organization. CTEK will always notify the Customer in writing (including by email) if this happens and will ensure that the transfer does not affect the Customer’s rights under the agreement.

This agreement is made between the Customer and CTEK. No third party has any rights under this agreement except someone to whom the Customer transfers their warranty (where CTEK may require reasonable proof that the new person is now the owner of the relevant product or property). Note, however, that the right to claim under the Consumer Sales Act follows the original buyer and not the product.
