Terms of Sale

1. Company Information

These general terms and conditions of sale (“Terms of Sale”) apply to CTEK Sweden AB (registered address Strandvägen 15, SE - 791 42 Falun, Sweden, Reg. No. 556540-3234) for purchases made by Australian end consumers via the website ctek.com (or applicable Australian regional site, the “Website”).

2. General

The Terms of Sale apply to all online sales by CTEK on the Website to end consumers in Australia, excluding the application of any other terms (e.g., terms applicable in physical retail stores). The Terms of Sale applicable to a purchase are those in effect at the time the order is placed.

These terms explain who CTEK is, how products are delivered to the Customer, how the contract may be amended or ended, what to do if problems arise, and other relevant legal information. Deviations from these Terms of Sale are only valid if agreed upon in writing by both parties. CTEK reserves the right to amend the Terms of Sale at any time; changes apply to all orders placed after such changes are posted on the Website.

3. Order Process

3.1 Product Selection

All online orders must be placed directly on the Website. The Customer selects product(s) by clicking the “Add to cart” button. The Customer can view selected products in the cart at any time, select available payment methods, and review applicable shipping fees.

3.2 Registration of the Order

Before finalising the order, the Customer can review order details and total pricing (including GST and shipping). Any input errors can be corrected prior to confirmation. The Customer enters the necessary delivery address and payment details.

3.3 Final Confirmation of the Order

By clicking the button to complete the purchase, the Customer accepts these Terms of Sale and CTEK’s Privacy Policy. Upon confirmation of payment, an electronic order confirmation is sent to the Customer’s email address. The purchase agreement is finalised when the Customer receives this order confirmation. CTEK reserves the right to decline or cancel orders (e.g., in cases of stock unavailability or anti-fraud checks), in which case an email notification and full refund will be issued.

4. Change of Mind Returns & Statutory Guarantees

4.1 Change of Mind (Voluntary Return Right)

In addition to your non-excludable rights under the Australian Consumer Law (ACL), CTEK offers a 14-day Change of Mind Policy. The Customer may request to return a product within fourteen (14) calendar days from the date the product was delivered.

4.2 Conditions for Returns

To exercise a Change of Mind return, the Customer must notify CTEK customer service prior to sending any goods back. Returns sent without prior notification may not be accepted.

  • Return Logistics & Warehouse Address: All returns must be securely packed and sent with tracking at the Customer’s expense to our Australian logistics partner:
    Logifix Freight Solutions
    Attn: CTEK Returns
144 Bridge Rd, Keysborough VIC 3173
    Phone: 1300 014 313 / Mobile: 0418 344 366

  • Condition: Products returned under the Change of Mind policy must be unused, in original saleable condition, with all packaging, accessories, manuals, and proof of purchase (invoice/receipt) included.

  • Refunds: Upon inspection and acceptance of the returned item at the Keysborough warehouse, CTEK will refund the purchase price (excluding any original express delivery fees or return freight costs) via the original payment method without undue delay.

5. Prices and Taxes

All prices on the Website are displayed in Australian Dollars (AUD). Unless explicitly stated otherwise, prices include Australian Goods and Services Tax (GST). Delivery/shipping costs are displayed separately at checkout before purchase confirmation. CTEK reserves the right to adjust prices prior to order confirmation.

6. Product Availability

Products and prices are subject to stock availability. "In stock" status on the Website is provided as a guide. If a product becomes unavailable after an order is placed, CTEK will inform the Customer by email and issue a full refund for any unavailable items within a reasonable timeframe.

7. Shipping and Delivery

7.1 Dispatch & Fulfillment

All orders placed within Australia are stored, fulfilled, and dispatched locally via our logistics partner:

Logifix Freight Solutions

VIC Head Office: 144 Bridge Rd, Keysborough VIC 3173

Phone: 1300 014 313 | Mobile: 0418 344 366

7.2 Shipping Options & Battery Regulations

Available shipping services, delivery fees, and estimated transit times are displayed at checkout.

  • Lithium / Hazmat Shipping: Certain products containing lithium batteries (e.g., CS FREE or Booster units) are classified as Dangerous Goods and must comply with Australian transport safety laws. These items may only be shipped via approved road express/standard freight carriers and cannot be delivered via certain air express services or to PO Boxes/Parcel Lockers where restricted.

7.3 Delivery Details

The Customer is responsible for providing accurate delivery details (full name, address, valid phone number, and email). CTEK and Logifix Freight Solutions are not liable for non-delivery or delays caused by incorrect address information provided by the Customer.

8. Inspection and Transit Issues

The Customer should inspect the packaging and delivered goods upon arrival. If goods arrive damaged in transit or incomplete:

  • Note any visible outer package damage with the courier driver upon signature (where applicable).

  • Contact CTEK Customer Support within 48 to 72 hours of delivery with photographic evidence of the damaged packaging and product, along with the order number and shipping label details, so a freight claim and replacement/refund can be arranged.

9. Payment Methods

Payments are processed securely through Shopify Payments and its supported payment providers (e.g., Visa, Mastercard, American Express, Apple Pay, Google Pay, or local buy-now-pay-later options such as Klarna/Afterpay where applicable). All transactional data is encrypted according to PCI-DSS standards. CTEK does not directly store credit card numbers. Deliveries will only be dispatched once full payment has cleared.

10. Title and Risk

Risk in the product (loss or damage) transfers to the Customer upon delivery to the specified address or receipt by the Customer. CTEK retains ownership and title to all ordered products until full payment has been received.

11. Consumer Guarantee Rights (Australian Consumer Law)

11.1 Non-Excludable Statutory Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

11.2 Voluntary Manufacturer Warranty

In addition to your statutory rights under the ACL, CTEK provides a voluntary manufacturer warranty against material or manufacturing defects:

  • Battery Chargers (under 10A): 5-year voluntary warranty.

  • Accessories: 2-year voluntary warranty.

This voluntary warranty does not cover defects or damage caused by improper installation, misuse, neglect, unapproved disassembly/repairs, water ingress outside rated IP specifications, normal wear and tear, or removal of product serial numbers.

To claim under CTEK’s manufacturer warranty, keep your tax invoice as proof of purchase and contact CTEK Customer Service or Logifix Freight Solutions for return authorisation instructions.

12. Limitation of Liability

To the maximum extent permitted by law (including the ACL):

  • CTEK is not liable for indirect, incidental, or consequential losses, loss of business revenue, loss of profits, business interruption, or loss of opportunity resulting from the use or inability to use any product.

  • Products offered on the Website are supplied for consumer and private use.

  • CTEK’s total liability for claims arising under these Terms of Sale shall not exceed the total price paid by the Customer for the specific product giving rise to the claim, except where prohibited under mandatory provisions of Australian law.

13. Intellectual Property

All content, trademarks, logos, texts, illustrations, and images on the Website are protected by copyright and intellectual property laws. Customers may not reproduce, modify, or use Website content for commercial purposes without prior written authorization from CTEK.

14. Personal Data & Privacy

CTEK processes personal information in accordance with applicable Australian privacy laws (Privacy Act 1988 (Cth)) and CTEK's Privacy Policy. For details on tracking technologies and cookie usage, please consult CTEK's Cookie Policy available on the Website.

15. Discount Codes and Promotional Offers

Promotional codes, vouchers, or gifts offered by CTEK apply strictly under the specified terms and validity periods of each campaign.

  • Discount codes cannot be combined with other offers unless explicitly stated.

  • Discount codes are single-use per order and non-refundable in the event of order cancellation or return.

  • CTEK reserves the right to reject or cancel orders using codes obtained through unauthorised channels or intended for specific target groups (e.g., employee or trade partner codes).

16. Severability and Governing Law

16.1 Governing Law

These Terms of Sale are governed by and construed in accordance with the laws of Victoria, Australia (or the Australian state or territory in which you reside). Both parties submit to the non-exclusive jurisdiction of the courts of Australia.

16.2 Severability

If any provision of these Terms of Sale is held to be invalid, illegal, or unenforceable under applicable law, that provision will be severed or interpreted to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
